BackgroundNational guidelines require programmes use subjective assessments of social support when determining transplant suitability, despite limited evidence linking it to outcomes. We examined how transplant providers weigh the importance of social support for kidney transplantation compared with other factors, and variation by clinical role and personal beliefs.MethodsThe National survey of the American Society of Transplant Surgeons and the Society of Transplant Social Work in 2016. Using a discrete choice approach, respondents compared two hypothetical patient profiles and selected one for transplantation. (...) Conditional logistic regression estimated the relative importance of each factor; results were stratified by clinical role and beliefs.ResultsFive hundred and eighy-four transplant providers completed the survey. Social support was the second most influential factor among transplant providers. Providers were most likely to choose a candidate who had social support, always adhered to a medical regimen, and had a 15 years life expectancy with transplant. Psychosocial providers were more influenced by adherence and quality of life compared with medical/surgical providers, who were more influenced by candidates' life expectancy with transplant. For providers concerned with avoiding organ waste, social support was the most influential factor, while it was the least influential for clinicians concerned with fairness.ConclusionsSocial support is highly influential in listing decisions and may exacerbate transplant disparities. Providers’ beliefs and reliance on social support in determining suitability vary considerably, raising concerns about transparency and justice. (shrink)

In the debate over proper judicial interpretation of the law, the doctrine of Originalism has been subjected to numerous, seemingly fatal criticisms. Despite the exposure of flaws that would normally bury a theory, however, Originalism continues to attract tremendous support, seeming to many to be the most sensible theory on offer. This paper examines its resilient appeal (with a particular focus on Scalia's Textualism).By surveying and identifying the fundamental weaknesses of three of the leading alternatives to Originalism (Popular Will theory, (...) Dworkin's value theory, and Minimalism), the paper demonstrates that the heart of Originalism's appeal rests in its promise of objectivity. The paper also establishes, however, that Originalism suffers from a misguided conception of what objectivity is. All camps in this debate, in fact, suffer from serious misunderstandings of the nature of objectivity. (shrink)

The article questions the concept of post-normal science and emphasizes that despite the declarative detachment from social practice and freedom from politics, de facto science has always been social. On the one hand, the scientific community has always been aristocratic. The “classical ethos” of science presupposes openness and equality on conditions that require enormous efforts and self-sacrifice, this equality is beyond the norm, because a “normal” scientist is, as K. Popper noted, mediocrity. On the other hand, scientists at all times (...) have taken an active social position, and the development of science has always been closely intertwined with social practices and the political process, as is well shown by T. Porter, L. Pinto, S. Shapin and S. Schaffer. From this point of view, science has always been post-normal – the “solutions” are always “urgent”, and the corresponding “stakes” are invariably “high”. However, the aristocracy of the scientific ethos and the declarative isolation of the scientific community from policy and politics are of fundamental importance for the reproduction of science, which practically cannot, but is morally obliged to remain outside of them. We spend a lot of time thinking about other people: their motivations, what they are thinking, why they want particular things. Sometimes we are aware of it, but it often occurs without conscious thought, and we can respond appropriately to other people's thoughts in a diverse range of situations. Measures of student ethical sensitivity and their increases help to answer questions such as whether accounting ethics should be taught at all. We investigate different sensitivity measures and alternatives to the well-established Defining Issues Test (DIT-2, Rest, J. R. et al. [1999, Postconventional Moral Thinking: A Neo-Kohlbergian Approach (Lawrence Erlbaum Associates, Mahwah, NJ]), frequently used to measure the effects of undergraduate accounting ethics education. Because the DIT measures cognitive development, which increases with age, the DIT scores for younger accounting students (...) are typically lower, have limited range, and are not likely to vary sufficiently with corresponding choices in ethical dilemmas. Since the DIT measures only the moral judgment component of ethical decision-making, we consider the multidimensional ethical scale (MES) to allow respondents to provide explanations for their moral and other judgments. The MES has been used to measure attitudes related to justice, utility, contractualism, egoism, and relativism. Unfortunately, the MES is not comparable in one-dimension to the DIT, and unlike the DIT, the MES has no theoretical or objective base. Therefore, we construct a comparable one-dimensional relative measure, a Composite MES Score, obtained from previous research on practicing accountants. We compare the reliability of this measure to the DIT in explaining the ethical choices of 54 specially chosen, somewhat homogeneous students, whose ages range from 18 to 19, and who are taking a second semester freshman accounting course at a private, religion-affiliated university. These particular students are relatively untrained in the formal use of questionable accounting choices. These students are less likely to recognize the dilemmas of the MES and are also less likely to demonstrate sufficient variation in their DIT scores, traditionally low for freshmen students. As freshmen, they are recent graduates of high school and more likely guided by other ethical influences including friends, family, or contractual obligations (some of the MES constructs) rather than higher cognitive development. This study confirms suspicions. We find the DIT scores do not vary sufficiently to explain the moral reasoning of freshmen. For eight dilemmas and 24 choices we find the DIT score correlates with only three choices, whereas the MES regression models have at least one significant construct for 23 out of 24 ethical choices. The Composite MES Score (a relative measure) also explains 23 out of 24 choices and is statistically related to the DIT in only one of the choices. Unlike the DIT, the Composite MES permits pretest and retesting with different dilemmas to evaluate changes in ethical sensitivity. These results argue for relative rather than absolute measures of sensitivity and guides beyond cognitive development (the DIT-score) to explain undergraduate student sensitivity. (shrink)

This essay contends that the debate between subjectivism and objectivism in ethics is better understood as a dispute among three alternatives: subjectivism, objectivism, and intrinsicism. Ayn Rand has identified intrinsicism – the belief that certain things are good “in, by, and of” themselves – as the doctrine that is actually operative in many defenses of moral objectivity. What intrinsicism fails to appreciate, however, is the significant role of the subject, the person to whom and for whom anything can be valuable. (...) Objective value, in Rand's view, is relational. Its existence depends on contributions of both external reality and human consciousness. Values are not reducible to psychological states, as in subjectivism, but nor are they independent of them, as in intrinsicism. Objectivity in ethics is attained neither through revelation of the intrinsic property of goodness nor through the subject's creation of goodness, but through a rational procedure of evaluation that is governed by the method of objectivity. This essay is in three parts, explaining Rand's view of exactly what intrinsicism is; elaborating on her view of the nature of moral objectivity; and highlighting certain features that make plain the differences between an intrinsicist and an objectivist account of value. While it is widely acknowledged that psychology is in the throes of a replication ‘crisis’, relatively little attention has been paid to the role theory plays in our evaluation of replications as ‘failed’ or ‘successful’. This paper applies well-known arguments in philosophy of science about the interplay between theory and experiment to a contemporary case study of infants’ understanding of false belief (Onishi and Baillargeon [2005]), and attempts to replicate it. It argues that the lack of consensus about over-arching theories (...) informing both the concepts under study and the methodologies used to track them means that researchers disagree over which experiments constitute replications of the original. The second part of the paper places this specific debate within a broader discussion of the replication crisis as a crisis of ‘theory’, developing work by Muthukrishna and Henrich ([2018]) and Bird ([2018]). Bird argues that the lack of agreed over-arching theories in psychology means that a high rate of replication failure is to be expected; this paper agrees with his diagnosis but challenges his proposal that more replication will resolve the problem. Inequities in access to oncology care among Indigenous peoples in Canada are well documented. Access to oncology care is mediated by a range of factors; however, emerging evidence suggests that healthcare providers, including nurses, play a significant role in shaping healthcare access. The purpose of this study was to critically examine access to oncology care among Indigenous peoples in Canada from the perspective of oncology nurses. Guided by postcolonial theoretical perspectives, interpretive descriptive and critical discourse analysis methodologies informed study design (...) and data analysis. Oncology nurses were recruited from across Canada to complete an online survey (n = 78). Nurses identified a range of barriers experienced by Indigenous peoples when accessing oncology care, yet located these barriers primarily at the individual and systems levels. Nurses perceived themselves as mediators of access to oncology care; however, their efforts to facilitate access to care were constrained by the dominance of biomedicine within healthcare. Nurses' constructions of access to oncology care highlight the embedded narrative of individualism within nursing practice and the relative invisibility of racism as a determinant of equitable access to care among Indigenous peoples. This suggests a need for oncology nurses to better understand and incorporate structural determinants of health perspectives. (shrink)

Evaluative contexts can be stressful, but relatively little is known about how different individuals who vary in responses to self-evaluation make emotion regulatory choices to cope in these situations. To address this gap, participants who vary in self-esteem gave an impromptu speech, rated how they perceived they had performed on multiple evaluative dimensions, and subsequently chose between disengaging attention from emotional processing and engaging with emotional processing via changing its meaning, while waiting to receive feedback regarding these evaluative dimensions. According (...) to our framework, distraction can offer stronger short-term relief than reappraisal, but, distraction is costly in the long run relative to reappraisal because it does not allow learning from evaluative feedback. We predicted and found that participants with lower self-esteem react defensively to threat of failure by seeking short-term relief via distraction over the long-term benefit of reappraisal, as perceived failure increases. Implications for the understanding of emotion regulation and self-esteem are discussed. (shrink)

The emphasis on evidence based medicine (EBM) has placed increased focus on finding timely answers to clinical questions in presence of patients. Using a combination of natural language processing for the generation of clinical excerpts and information theoretic distance based clustering, we evaluated multiple approaches for the efficient presentation of context-sensitive EBM excerpts.

We investigated the impact of frequency of interruptions in a simulated medical visual search task. Participants performed the visual search task during which they were interrupted by a number-classification task in 25, 50, or 75% of all trials, respectively, reflecting the frequency conditions. Target presence and interruption were varied within-subjects, and interruption frequency was varied between-subjects. Globally, on a frequency condition level, participants in the low frequency condition had longer mean response times for the primary visual search task than in (...) the high condition, but there were no other performance differences between the three frequency conditions. Locally, on the level of specific interruption effects, accuracy decreased directly after interruptions for target present but not for target absent trials. Furthermore, interruptions caused significant interruption costs, reflected in slower overall RTs in interrupted than in uninterrupted trials. The combined findings show that especially for critical visual search tasks as in the medical field, interruptions—regardless of frequency—should be avoided. (shrink)

Néanmoins cette question est-elle légitime? Nous faisons tous une expérience de l'être, à la fois externe et interne, sous la forme du monde et sous la forme du sujet. En lieu et place du rien nous trouvons toujours quelque chose. Aussi Lavelle, (...) après Bergson, conteste-t-il la présence contradictoire du néant au sein de l'être : ce dernier est partout présent, et c'est pourquoi l'ontologie lavellienne est résolument optimiste. Dans cet exposé dense et clair, le philosophe dessine le cercle qui lie d'une manière indestructible le renouvellement et la manifestation de chaque chose au moyen de trois concepts : l'être, l'existence et la réalité. Bien qu'univoque, l'être se décline en effet selon un mouvement de donation qui a pour fil conducteur la catégorie charnière de l'existence. Mais la démarche de Lavelle ne s'arrête pas là, elle tend à nous montrer que l'articulation des trois notions précédentes doit être elle-même comprise en relation avec les catégories axiologiques que sont le bien, la valeur et l'idéal. L'être est pour Lavelle la source de toute positivité, et c'est pourquoi son ontologie, qui comble en même temps notre intellect et notre volonté, renoue par-delà le christianisme avec la grande tradition grecque, en nous proposant les principes d'une sagesse possible ici et maintenant. Philosophers and psychologists have often maintained that in order to attribute mental states to other people one must have a ‘theory of mind’. This theory facilitates our grasp of other people’s mental states. Debate has then focussed on the form this theory should take. Recently a new approach has been suggested, which I call the ‘Direct Perception approach to social cognition’. This approach maintains that we can directly perceive other people’s mental states. It opposes traditional views on two counts: by (...) claiming that mental states are observable and by claiming that we can attribute them to others without the need for a theory of mind. This paper argues that there are two readings of the direct perception claims: a strong and a weak one. The Theory-theory is compatible with the weak version but not the strong one. The paper argues that the strong version of direct perception is untenable, drawing on evidence from the mirror neuron literature and arguments from the philosophy of science and perception to support this claim. It suggests that one traditional ‘theory of mind’ view, the ‘Theory-theory’ view, is compatible with the claim that mental states are observable, and concludes that direct perception views do not offer a viable alternative to theory of mind approaches to social cognition. As nursing professionals, we believe access to healthcare is fundamental to health and that it is a determinant of health. Therefore, evidence suggesting access to healthcare is problematic for many Indigenous peoples is concerning. While biomedical perspectives underlie our current understanding of access, considering alternate perspectives could expand our awareness of and ability to address this issue. In this paper, we critique how access to healthcare is understood through a biomedical lens, how a postcolonial theoretical lens can extend that understanding, (...) and the subsequent implications this alternative view raises for the nursing profession. Drawing on peer‐reviewed published and gray literature concerning healthcare access and Indigenous peoples to inform this critique, we focus on the underlying theoretical lens shaping our current understanding of access. A postcolonial analysis provides a way of understanding healthcare as a social space and social relationship, presenting a unique perspective on access to healthcare. The novelty of this finding is of particular importance for the profession of nursing, as we are well situated to influence these social aspects, improving access to healthcare services broadly, and among Indigenous peoples specifically. The aim of this study was to investigate the ethical dilemma of prioritising financial resources to expensive biological therapies. For this purpose, the four principles of biomedical ethics formulated by ethicists Tom Beauchamp and James Childress were used as a theoretical framework. Based on arguments of justice, Beauchamp and Childress advocate for a health care system organised in line with the Danish system. Notably, our study was carried out in a Danish setting.

Background Doctors sometimes encounter parents who object to prescribed treatment for their children, and request suboptimal substitutes be administered instead. Previous studies have focused on parental refusal of treatment and when this should be permitted, but the ethics of requests for suboptimal treatment has not been explored. Methods The paper consists of two parts: an empirical analysis and an ethical analysis. We performed an online survey with a sample of the general public to assess respondents’ thresholds for acceptable harm and (...) expense resulting from parental choice, and the role that religion played in their judgement. We also identified and applied existing ethical frameworks to the case described in the survey to compare theoretical and empirical results. Results Two hundred and forty-two Mechanical Turk workers took our survey and there were 178 valid responses. Respondents’ agreement to provide treatment decreased as the risk or cost of the requested substitute increased. More than 50% of participants were prepared to provide treatment that would involve a small absolute increased risk of death for the child and a cost increase of US$<500, respectively. Religiously motivated requests were significantly more likely to be allowed. Existing ethical frameworks largely yielded ambiguous results for the case. There were clear inconsistencies between the theoretical and empirical results. Conclusion Drawing on both survey results and ethical analysis, we propose a potential model and thresholds for deciding about the permissibility of suboptimal treatment requests. (shrink)

The purpose of this study was to determine whether accounting students’ perception of moral intensity could be enhanced through a limited ethics intervention in an Advanced Accounting course. Ethical decisions are heavily influenced by the intensity of the moral problem: the more egregious the act, the more the people view it as unethical. This controlled experiment measures the change in perceptions of moral intensity with the pre- and post-test instruments using five accounting specific vignettes containing moral dilemmas which are progressively (...) more intense. While other studies have shown that perceived moral intensity directly influences a persons’ moral decision-making process, as far as we are aware, this is the first study that assesses and tests whether the coverage of specific ethics content integrated into an accounting class can positively influence the students’ perception of moral intensity, moral sensitivity/awareness, moral judgment, and moral intentions. Positively influencing students’ moral sensitivity/awareness, moral judgment, and moral intentions is a critical first step to ensuring that our courses and curricula provide the learning environment in which students can develop knowledge and competencies required to become the ethical leaders of tomorrow. Using the coorientation approach, this study explores the ethical values of citizen photojournalists and professional photojournalists, the extent to which they agree about these values, how accurate they are in assessing each others' values, and how congruent they perceive they are with each other.

Comme cette première période a été marquée par le développement de la société esclavagiste barbadienne et la croissance de la communauté des libres de couleur, ces documents donnent un aperçu des relations établies avec (...) les propriétaires d’esclaves et l’administration coloniale. L’une de ces séries documentaires concerne « Free Jenny » ou Jane Hallett qui résidait vers 1690-1740 dans la région connue sous le nom de « The Cameroons » ainsi que Sarah Hallett qui résidait à proximité de Halletts à Saint Michael. On y voit de quelle façon la terre se transmettait des élites blanches masculines à leurs familles blanches et non-blanches. On y voit aussi combien ces legs de terre étaient ténus. Today's sweatshops violate our notions of justice, yet they continue to flourish. This is so because we have not settled on criteria that would allow us to condemn and do away with them and because the poor working conditions in certain places are preferable to the alternative of no job at all. In this paper, we examine these phenomena. We consider the definitional dilemmas posed by sweatshops by routing a standard definition of sweatshops through the precepts put forward in the (...) literature on justice and virtue ethics. We conclude that fixing on definitions is pointless and misleading and that we are better off looking at whether or not a workplace violates the basic human rights of workers and whether or not the working conditions there cohere with situations on which we have already rendered judgments. In the end, we suggest guidelines for businesses that operate in the global workplace to help them avoid charges of running sweatshops. These recommendations account for the harsh living conditions in certain developing and emerging countries as well as the norms of societies in developed countries. (shrink)

In an essayistic and experimental approach, which includes the reconstruction of conceptual contexts and poetic writing, this article interrogates the passages and hybridizations between poetry and philosophy from the point of view of their relation to Eros. Thus, in dialogues with Sappho, Anne Carson, Walter Benjamin and Hans Blumenberg, I present the notion of “eroticization of language” as a point of convergence between poetic production and theoretical impulse.

Abstract:Christian Bendayán (Iquitos, Peru 1973 -) is one of a cadre of visual artists from Iquitos, Peru that has cultivated an Amazonian pop aesthetic over the last decade. Bendayán creates an alternative, counter-dominant viewpoint to seemingly intractable archival versions of the Amazon and its peoples. The place, its habitants, and its flora and fauna have been documented in published texts and drawings by sixteenth-century missionaries, eighteenth-century botanists, nineteenth-century rubber barons, and countless adventurers. I argue that Bendayán queers some of these (...) archival documents through his incorporation of gender non-conforming and homoerotic figures into his depiction of Iquitos. Additionally, he reconfigures images and texts from previous eras via his transformation of historical facts into open-ended narratives that reflect a queer temporality that toggles back and forth between the past, the present and the future. Through his transformation of archival materials, and his incorporation of local myths and pop culture, he presents physical desire not as a means to procreation, but as an end in and of itself. In sum, through his paintings, Bendayán perceives from and with Iquitos. He turns his city into a distinct viewpoint instead of a fantastical destination for the projections of outsiders. (shrink)

Omar Khadr was arrested at the age of 15 by the U.S military and has remained in custody in Guantanamo for 8 years. Today, he plead guilty to five war crime charges. Despite stating in open court last summer that he would not plead guilty, today he muttered a confession. In accordance with the plea bargain, Khadr plead guilty to murder, attempted murder, conspiracy, providing material support to terrorists, and spying. Following this, a jury imposed the harshest possible sentence, 40 (...) years imprisonment. Khadr may receive parole after eight years. The first year of this sentence will be served in Gauntanamo, following which he may be repatriated. The government of Canada does not have to repatriate Khadr, nor is parole guaranteed. Rather than hypothesizing outcomes, I want to discuss the case philosophically. (shrink)

RESUMO Este artigo constrói uma afinidade entre a noção benjaminiana de “semelhança não sensível” e o “trabalho da semelhança” do qual fala Ricœur a propósito da metáfora. Para isso pressupõe uma referência comum: o princípio kantiano das afinidades, que corresponde ao poder de produzir e de perceber ao mesmo tempo a diferença na identidade e a identidade na diferença, constituindo o modo de funcionamento do esquematismo em geral. Seguindo caminhos diferentes, Benjamin e Ricœur tematizam essa tensão comparativa que caracteriza a (...) imaginação, examinando sua ação na construção poética e na reflexividade que lhe é inerente. ABSTRACT The present article builds na affinity between the Benjamininan notion of “non-sensitive likeness” and the “work of likeness” talked about by Ricœur, regarding the metaphor. For that purpose he presupposes a common reference: Kant’s principle of affinities, which corresponds power of producing and noticing, at the same time, the difference in identity and the identity in difference, thus building the modus operandi of the schamtism in general. Following diverse paths, Benjamin and Ricœur thematize that comparative tension characteristic of imagination also examining its effect in poetic construction and in its inherent reflectivity.
